Western Alliance initiating legal action to collect amount owed

Western Alliance Bancorp (WAL.N) has initiated legal action to recover $98 million from the Cantor Group, alleging fraud related to collateral misrepresentation in a loan agreement. The bank filed the lawsuit in August 2025, accusing the borrower of forging title insurance policies to conceal existing claims on properties pledged as collateral. Western Alliance reported setting aside $30 million in reserves for potential losses tied to the loan during its third-quarter earnings disclosure.

The bank's CEO, Kenneth Vecchione, emphasized that the issue is an "isolated case" within its note finance portfolio and stated that enhanced monitoring practices have been implemented to prevent similar incidents. A review of loans exceeding $10 million in the portfolio found no additional irregularities, according to executives.

The legal action is part of a broader pattern of bad loans linked to California-based real estate investor Andrew Stupin and his associate Gerald Marcil. Stupin faces lawsuits from multiple lenders, including Banc of California and Enterprise Bank & Trust, over $270 million in troubled debt tied to commercial real estate. Zions Bancorp (ZION.O) also disclosed a $50 million charge-off related to loans to the same borrowers, citing fraudulent transfers of collateral.

Stupin's attorney, Brandon Tran, has disputed the allegations, calling them "unfounded" and claiming they misrepresent the facts. Analysts note that regional banks, with higher exposure to commercial real estate, may face increased scrutiny as investors remain wary of credit risks amid economic uncertainties.

Shares of Western Alliance rose 2% in midday trading following the CEO's reassurances, while regional bank stocks overall faced volatility after Zions and Western Alliance's disclosures. The cases highlight growing concerns over non-bank financial players and collateral verification practices in the sector.
