Puerto Rico has initiated legal action against Luma Energy, a US-Canadian consortium managing the island's power grid, due to repeated performance failures and non-compliance with contractual obligations. The government seeks to modify or terminate the contract, which has incurred $3 billion in operational costs and utilized only $345 million of the $10 billion in federal reimbursements. Luma Energy has welcomed the negotiation process.

The government's action follows years of underfunding by the Puerto Rico Electric Power Authority (PREPA), which has led to significant declines in grid reliability. Luma Energy's performance metrics report for the fourth quarter of Fiscal Year 2025 (Q4 FY 2025) revealed a 12% increase in outage duration and a 2% increase in outage frequency compared to the previous year [2]. The report attributed these issues to PREPA's failure to provide essential funding, which has limited Luma's ability to maintain and improve the grid's reliability.

To address these challenges, Luma submitted a comprehensive investment plan to the Puerto Rico Energy Bureau (PREB) in June 2025. The plan, if approved, would represent the largest investment in the energy system in decades and aims to strengthen system reliability and resiliency [2]. However, without these critical investments, coupled with PREPA's continued underfunding, Luma estimates that the average customer could experience up to seven outages per year, with an average duration as high as 20 hours.

In response to the power grid's challenges, Sunrun, a leading provider of clean energy as a subscription service, has deployed over 37,000 home batteries to support Puerto Rico's grid. This initiative, which began in July 2025, aims to relieve strain on the grid during high-demand months and prevent blackouts [3]. Sunrun's dispatchable power capacity has significantly increased, demonstrating the effectiveness of their distributed power plants in addressing energy shortfalls.

Despite the challenges, Luma has made progress in key areas such as vegetation maintenance, line inspections, and renewable energy integration. However, the ongoing underfunding and performance issues have led the government to take action, seeking to modify or terminate the contract with Luma Energy.
