Cinkciarz.pl also criticizes the Polish financial regulator KNF for revoking its payment services license, which could affect 100,000 users and cause significant financial damage.

In a bold move against the Polish banking sector, fintech companies Cinkciarz.pl and Conotoxia have filed a combined lawsuit against ten banks, including Citibank and PKO BP, for a staggering 6.5 billion zlotys (approximately $1.6 billion) [1]. The firms accuse the banks of engaging in anti-competitive practices, refusal to provide financing, and collusion. Additionally, Cinkciarz.pl has criticized the Polish financial regulator, KNF, for revoking its payment services license, which could impact 100,000 users and cause significant financial harm [2].

Financial technology (fintech) companies, such as Cinkciarz.pl and Conotoxia, play a crucial role in the financial sector by automating and enhancing the delivery and application of financial services [3]. While the term fintech originated in the 1990s as a back-end system technology for traditional financial institutions, its focus has expanded to consumer services. However, these new entrants into the market often face resistance from established players [4].

Cinkciarz.pl claims that Bank BPS, one of the defendant banks, has systematically prevented it from executing reverse transfers for customers since September 26, under the pretext of IT problems [2]. The company argues that these actions constitute a deliberate and ongoing effort to hinder its market access, impacting both the firm and its customers. Moreover, Cinkciarz.pl is calling for intervention from Poland's financial regulators, including the KNF and the Office of Competition and Consumer Protection (UOKiK) [2].

This lawsuit serves as a reminder of the ongoing challenges faced by fintech companies in navigating the complex and sometimes contentious relationship between traditional financial institutions and regulatory bodies. As the financial landscape continues to evolve, it is essential for regulators to foster a competitive and inclusive environment that encourages innovation and growth.
