The Internal Revenue Service (IRS) and its Chief Executive Officer, Frank J. Bisignano, are under increasing scrutiny from lawmakers amid two high-profile controversies: unauthorized disclosure of taxpayer data to immigration authorities and the termination of collective bargaining agreements with employee unions.
A federal judge recently ruled that the IRS violated privacy laws by sharing confidential taxpayer addresses with Immigration and Customs Enforcement (ICE) approximately 42,695 times. The court cited IRS Code 6103, which prohibits the disclosure of tax return information without proper legal justification. The ruling highlights concerns that the IRS failed to verify ICE's requests for data, which critics argue facilitated mass deportation efforts under the Trump administration. The Center for Taxpayer Rights, which sued the government over the data-sharing practices, emphasized that taxpayer information is "uniquely sensitive" and warned of systemic risks to privacy protections.
Simultaneously, the IRS has rescinded its collective bargaining agreement with the National Treasury Employee Union, which represents roughly two-thirds of IRS staff. The move followed an executive order expanding national security exemptions to collective bargaining for federal agencies. Democratic lawmakers, including Ways and Means Committee Ranking Member Richard E. Neal (D-MA), condemned the decision as a violation of congressional intent and a disruption to IRS operations during a critical tax filing season.
Bisignano is set to address these issues during a March 4 hearing before the House Committee on Ways and Means. Lawmakers are expected to press him on the IRS's compliance with privacy laws, its enforcement strategies, and steps to restore union rights. The hearing comes as the IRS faces multiple legal challenges, including ongoing appeals over the ICE data-sharing agreement and injunctions blocking large-scale data transfers.
These controversies underscore broader tensions between the IRS, Congress, and advocacy groups over balancing enforcement priorities with taxpayer rights and employee protections. With the agency navigating significant operational and legal challenges, the outcome of these disputes could shape the IRS's role in the evolving federal landscape.
