The recent signing of three landmark proposals by California Governor Gavin Newsom has brought the issue of deepfakes in political ads to the forefront. These laws, designed to crack down on the use of AI to create and circulate false images and videos in political ads, have sparked a legal challenge and raised concerns about free speech rights.
The lawsuit, filed by a person who created parody videos featuring altered audios of Vice President and Democratic presidential nominee Kamala Harris, argues that the laws censor free speech and allow anybody to take legal action over content they dislike. The complainant, a conservative activist, is represented by attorney Theodore Frank, who maintains that the California laws are too far-reaching and are designed to "force social media companies to censor and harass people."
The governor's office, however, has stated that the new disclosure law for election misinformation is not any more onerous than laws already passed in other states, including Alabama. The law does not ban satire and parody content but requires the disclosure of the use of AI to be displayed within the altered videos or images.
The most sweeping of the three laws, which targets materials that could affect how people vote, as well as any videos and images that could misrepresent election integrity, has been criticized by free speech advocates and Elon Musk as unconstitutional and an infringement on the First Amendment. Musk shared an AI-generated video featuring altered audios of Harris on his social media platform, X, in defiance of the new law.
If these laws are deemed unconstitutional, social media platforms may adopt alternative legal strategies to address deepfakes and other AI-generated content. One approach could be to implement strict content moderation policies, requiring users to verify the authenticity of shared content before it is posted. Another option is to partner with fact-checking organizations to identify and flag misleading or false content.
The balance between free speech and election integrity in the context of AI-generated content is a delicate one. While the laws aim to prevent the erosion of public trust in U.S. elections, critics argue that they may infringe upon the rights of creators and platforms to share and disseminate information. The outcome of this lawsuit will be crucial in shaping the future of AI regulation and the protection of free speech in the digital age.
