Elon Musk has intensified his legal battle against OpenAI, seeking to prevent its transformation into a for-profit entity. He argues that a judicial intervention is crucial to safeguard his AI startup, xAI, and public interests from the growing dominance of OpenAI, known for its ChatGPT technology.
In the latest court filings, Musk continues his years-long critique of OpenAI CEO Sam Altman, with whom he co-founded OpenAI as a non-profit organization intended to develop generative AI for societal benefit. Musk asserts that OpenAI's acceptance of significant investments from Microsoft since 2019 contravenes this original non-profit mission. He now claims without immediate legal action, OpenAI's expansion could stifle competition irreversibly.
OpenAI, however, has dismissed Musk's claims as repetitive and without merit, describing them as entirely lacking legal basis. This dispute comes as reports have emerged that OpenAI is in early discussions with California's Attorney General about corporate restructuring.
Musk initially brought a lawsuit against OpenAI in California earlier this year but withdrew it in June, only to refile in federal court in Oakland in August. His legal strategy now seeks to halt OpenAI's restructuring until the litigation concludes. He further requests the court to block any OpenAI agreements with investors that might exclude funding for competitors, arguing that such terms breach federal antitrust laws.
The legal friction has notably escalated, portraying what some analysts see as a clash between Musk's growing AI ambitions and OpenAI's strategic transformations. Musk's xAI, founded last year, quickly achieved a valuation of $50 billion following substantial capital infusion, underscoring the competitive stakes involved in the burgeoning AI sector.
OpenAI, initially a non-profit entity since its inception in 2015, has transitioned to a "capped-profit" model, with its for-profit subsidiary governed by the non-profit parent. With Microsoft as a major financial backer, to the tune of nearly $14 billion, OpenAI is now moving toward a fully for-profit structure.
