Crypto Developer Storm Faces 45-Year Sentence Amid Defense Claims of Prosecution Errors
Roman Storm’s legal defense team has highlighted what they describe as “serious errors” in the prosecution’s case against him as his trial begins. The trial, which commenced the week of July 14, involves Storm, a developer associated with the crypto mixer Tornado Cash, facing charges of money laundering, conspiracy to operate an unlicensed money transmitting business, and sanctions violations.
According to a court filing submitted by Storm’s counsel on July 12, the defense argues that the prosecution’s case is riddled with “factual inaccuracies” that could compromise the integrity of the evidence presented to the jury. Specifically, the defense contends that key Telegram messages from alleged co-conspirator Alex Pertsev’s phone, which the prosecution intends to use as evidence, are incomplete and unreliable. The defense claims that these messages are “cherry-picked” and lack critical information, such as the identification of the authors of forwarded messages, which undermines their credibility.
“It appears the Telegram messages that were extracted are not accurate,” the defense document states. “The fact that they are plainly missing critical information undermines their reliability.” This assertion by Storm’s legal team suggests that the prosecution may have manipulated or misrepresented the evidence to support their case, raising questions about the fairness of the trial.
As the trial progresses, Storm has made an urgent plea for financial support. In a July 12 post, Storm called on his followers to contribute to his legal defense fund, stating that he needs to raise $500,000 in the next few days and $1.5 million within a couple of weeks to cover escalating legal fees, expert witnesses, and research. Storm emphasized that his team is working tirelessly to defend code as free speech, protect software development, and push back against what he perceives as government overreach.
If convicted, Storm faces a maximum sentence of 45 years in prison. The actual sentence, however, will be determined by the judge and federal sentencing guidelines. The defense’s allegations of errors and inaccuracies in the prosecution’s case could significantly impact the outcome of the trial, potentially leading to a more favorable verdict for Storm.
