CME Group CEO Terry Duffy announced on June 4, 2026, that the company plans to file litigation against U.S. regulators over the approval of perpetual cryptocurrency futures, which he described as a systemic risk to the financial system. Speaking at the Global Exchange & Fintech conference, Duffy criticized the Commodity Futures Trading Commission (CFTC) for its process in approving the novel products, calling it "extremely risky" and a disaster waiting to happen.

Perpetual futures, or "perps," are derivatives without an expiration date and often allow for high leverage—up to 50-to-1—amplifying exposure to market movements. Duffy expressed concerns that these products, combined with automatic liquidation models, could harm retail investors who may not fully understand the risks involved.

The CFTC has approved perps on a case-by-case basis, with exchanges like Coinbase and Kalshi launching the products for U.S. investors. However, Duffy argued that institutional demand remains limited and that traditional futures are still the preferred instruments for institutional clients.

Duffy also criticized the CFTC for bypassing a full review of the complex instruments, calling the process hasty. His comments reflect broader concerns within the financial industry about the regulatory approach to emerging crypto products and their potential impact on market stability.
