Alex Mashinsky, the founder of
Network, is facing a significant legal battle as his lawyers have criticized the U.S. government's request for a 20-year prison sentence, labeling it as a "death-in-prison sentence" for a non-violent, first-time offender. The legal team argues that the prosecution's portrayal of Mashinsky is harsh and disconnected from his actual actions, stripping him of his humanity.In a recent filing, Mashinsky’s lawyers contended that the government’s submission recasts the case as one involving a predator with malicious intent to target and harm victims. They claim that the Department of Justice has ignored Mashinsky’s background, including his family's persecution as Soviet Jewish refuseniks and his service in the Israeli Defense Forces, to dehumanize him. The lawyers also highlighted Mashinsky’s successful business ventures over the past thirty years in heavily regulated environments, noting that he had no prior blemishes on his record before Celsius.
The defense argues that the DOJ’s narrative paints Mashinsky as a sudden transformation from a dedicated servant to a fiend, which is absurd given his lifelong commitment to service. They also criticized the prosecution for using "savage and primal terms usually reserved for the most violent criminals," such as claiming that Mashinsky deliberately targeted real people, plundered and preyed on them, destroyed lives, and showed no contrition. The defense has asked the court to consider Mashinsky as a "whole person" ahead of the May 8 sentencing.
Prosecutors, on the other hand, are seeking a 20-year prison sentence for Mashinsky, alleging that his actions constituted a calculated fraud that resulted in billions of dollars in losses for thousands of customers. Reports indicate that Mashinsky and his wife withdrew an estimated $12 million in crypto from the Celsius Network before the bankruptcy proceedings began. Celsius, which was launched in 2018, grew to 200 employees and managed around $10 billion in crypto assets by 2021.
More than 200 victim statements have been submitted ahead of sentencing, with many calling for a life sentence for Mashinsky. The legal battle highlights the complex nature of the case and the differing perspectives between the prosecution and the defense. The outcome of the sentencing will have significant implications for Mashinsky and the broader crypto community.
