Westlock County in Canada is set to review and potentially amend its regulations to accommodate larger digital infrastructure projects. This move comes as the region has seen an increase in proposals for high-powered facilities, prompting the county to consider changes to its Data Processing Facilities Bylaw. The amendment, which was initially passed in April 2022, aims to create a more conducive environment for digital firms to establish larger facilities within the county.

The proposed amendments will categorize data processing facilities into two divisions based on their electrical energy requirements. Facilities that use one megawatt or more will be classified as Major Facilities and will be restricted to operating in industrial zones. In contrast, Minor Facilities, which use less than one megawatt, can be located anywhere, subject to the discretion of the development authority. However, agricultural lands can be rezoned to industrial land if there is a sufficient need and public concerns are addressed through a public hearing process.

One of the primary concerns with data processing facilities is the noise pollution they generate. The low hum noise from these facilities, along with increased traffic and construction noise, can be disruptive to nearby residents. To mitigate this issue, the new amendment includes a provision that allows the development authority to request a noise mitigation plan, which may include a noise monitoring program.

The county's decision to revisit its regulations follows a surge in proposals for larger facilities, particularly for Bitcoin mining. The initial bylaw, passed in 2022, was a response to the influx of Bitcoin mining applications and the subsequent concerns and complaints from residents. The county's planning and development department was inundated with inquiries and grievances related to these mining operations.

Westlock County, along with Sturgeon County, was one of the first regions to address the influx of Bitcoin mining. The county council has approved the first reading of the amended bylaw and scheduled a public hearing for September 9 at 9:30 AM. This hearing will provide an opportunity for residents and stakeholders to voice their opinions and concerns regarding the proposed changes.
