The High Court in London has rejected BHP's application for an anti-suit injunction to block class action firm Pogust Goodhead's use of Section 1782 to seek a deposition in ongoing litigation over the 2015 Fundao dam collapse in Brazil. The court found no basis to characterize Pogust Goodhead's move as vexatious, oppressive, or unconscionable, as argued by BHP. Pogust Goodhead welcomes the ruling, stating that the deposition serves a legitimate purpose in understanding Renova's role in relation to the settlements.
