Avi Eisenberg Sentenced to 52 Months for Child Exploitation Material
Avi Eisenberg, the individual responsible for exploiting Mango Markets and stealing $110 million in 2022, has been sentenced to 52 months in prison. The sentencing was based on his guilty plea to the possession of child sexual exploitation material, not for his conviction related to the crypto theft. This development comes a year after a jury found Eisenberg guilty of wire fraud, commodities fraud, and commodities manipulation for his actions on Mango Markets. Additionally, he pleaded guilty to possessing child sexual abuse material, which was discovered on his devices following his arrest.
Eisenberg's defense team had previously requested either a new trial or an acquittal on the Mango Markets-related charges. They argued that the Department of Justice had pursued the case in the wrong venue and that the government had not adequately proven that the mngo Perpetual was a "swap." They also claimed that Eisenberg's actions were not intended to manipulate the MNGO Perpetual's price and that his alleged deceptions were immaterial. However, Judge Arun Subramanian, during a hearing in Manhattan, stated that there was a "non-zero chance" he would grant the motion related to the Mango Markets charges. The judge emphasized that the bulk of any sentence would be related to the child sexual abuse material charge, stating that a prison sentence was necessary to deter the distribution of such material.
The judge acknowledged Eisenberg's efforts to understand the impact of his crimes but maintained that a prison sentence was still necessary. Eisenberg will serve five years of probation with strict rules after his release from prison. He will be required to install monitoring software on all his electronic devices and undergo a drug outpatient program. Prosecutors had requested a sentence of between 6.5 and 8 years in prison, highlighting the seriousness of Eisenberg's offenses. They argued that Eisenberg was aware that his actions on Mango Markets were criminal, citing his previous lawsuit against someone else for crypto-related market manipulation and his attempt to flee to Israel after his identity as the attacker was revealed.
Eisenberg has maintained that his actions on Mango Markets were compliant with the protocol and thus did not break the law. Prosecutors detailed Eisenberg's child sexual abuse material charges, stating that between 2017 and 2022, he downloaded 1,274 sexually-explicit images and videos of children, including toddlers and two-month-old infants, as well as depictions of sadistic violence and masochism against children. In their sentencing submission, Eisenberg and his lawyers attempted to attribute his crimes to his strict religious upbringing and lifelong struggles to conform to social norms, describing him as a "fundamentally decent person" and detailing his challenges adapting to life in jail.
