The Department of War’s designation of Anthropic as a supply chain risk has sparked legal and operational uncertainty, though the company emphasized that most customers remain unaffected. Secretary of War Pete Hegseth announced the move following unresolved negotiations over Anthropic’s refusal to permit its AI model, Claude, to be used for mass domestic surveillance or fully autonomous weapons according to Anthropic's statement. Anthropic stated it has not received direct communication from the Department of War or the White House regarding the status of negotiations but reiterated its position that current AI systems lack reliability for autonomous weapons and that mass surveillance conflicts with democratic principles as detailed in their announcement.
Legally, a supply chain risk designation under 10 USC 3252 applies only to the use of Claude in Department of War contracts, not to broader commercial activities. Anthropic clarified that individual customers or those with commercial contracts can continue using its services without disruption. For Department of War contractors, the designation would restrict Claude's use exclusively to non-military purposes if formally adopted. The company also contested Secretary Hegseth’s claim that the designation would broadly prohibit business with military partners, asserting the Secretary lacks statutory authority to enforce such a restriction.
Anthropic announced it will challenge the designation in court, calling it an unprecedented action historically reserved for foreign adversaries. The company emphasized its role in supporting U.S. military operations since June 2024 and expressed intent to facilitate a smooth transition if removed. Legal experts noted the ambiguity of Hegseth’s directive, with some suggesting the move could deter tech firms from engaging with defense contracts. While Anthropic’s business partners, including major tech firms, have not yet commented, the dispute highlights tensions between national security priorities and corporate governance in AI development.
