On Friday, Maryland Delegate Adrian Boafo and New York Assemblyman Clyde Vanel sent a joint letter to Democratic Congressional leaders, urging them to pass comprehensive crypto legislation at the federal level. The letter highlighted New York State's leadership in crypto regulation and proposed using New York’s BitLicense as a model for federal crypto regulation. The authors also noted New York State's two-year moratorium on proof-of-work cryptocurrency mining that uses fossilFOSL-- fuels, suggesting this could be considered at the federal level.

Critics argue that adopting New York’s BitLicense at the federal level would stifle innovation and entrepreneurship. The BitLicense requires extensive paperwork and significant financial investment, making it difficult for many companies, especially start-ups, to operate in New York. This has led to the exclusion of reputable platforms and services from the state, affecting residents' access to crypto products. A federal BitLicense could create a similar barrier, hindering the growth of the crypto industry and preventing the United States from becoming a global leader in Bitcoin and crypto.

The letter also proposed a mining moratorium on Bitcoin miners that use fossil fuels, which critics view as virtue signaling rather than a genuine effort to address environmental concerns. While the intention to reduce fossil fuel use is commendable, the moratorium could put many Americans out of work and cede the hashrate to foreign powers who continue to use fossil fuels for mining. Critics argue that a more comprehensive approach to reducing fossil fuel use, rather than targeting a specific industry, would be more effective.

The letter's authors and other Democrats, such as Rep. Maxine Waters and Senator Elizabeth Warren, have been criticized for proposing regulations that could harm the crypto industry. Instead, critics suggest that Democrats should look to more forward-thinking politicians, such as Congressman Ro Khanna, Congressman Ritchie Torres, and former Congressman Wiley Nickel, who support the growth of the Bitcoin and crypto industry in the United States. These politicians recognize the potential of the industry to provide high-quality jobs and drive economic growth.
