German authorities may have overlooked approximately 45,060 BitcoinBTC-- linked to the defunct piracy site Movie2K, potentially missing out on seizing digital assets valued at nearly $5 billion, according to data from blockchain analytics firm Arkham. The firm reported that the Bitcoin remains in over 100 wallets and has not moved since 2019. Arkham believes these funds are still controlled by the site’s original operators. This revelation raises questions about the completeness of the seizure efforts by German law enforcement, which had previously confiscated 49,858 Bitcoin in January 2024. The earlier batch was sold between June and July 2024 at an average price of $57,900 per BTC, netting the German government approximately $2.8 billion. At current prices, the 45,000 BTC that remain untouched is valued at nearly $4.99 billion.

German prosecutors defended the earlier liquidation by citing legal requirements to quickly sell volatile assets like cryptocurrencies to avoid potential losses of 10% or more. However, the timing of the sale has drawn criticism, as Bitcoin’s price surged past $100,000 in December 2024, peaking at $124,128 in mid-August 2024. By that time, the previously sold Bitcoin would have been worth over $5 billion. Arkham emphasized that the additional Bitcoin was not mentioned in the official sale announcement, suggesting a gap in the government’s tracking or acknowledgment of the total seized assets. With Bitcoin trading near $111,000 as of the report’s publication, the potential financial gain from the untapped stash continues to grow.

To legally seize the newly identified Bitcoin, German authorities must prove in court that the assets are proceeds of crime and directly tied to the Movie2K case. Even if successful, enforcement would require identifying the operators of the wallets and gaining control of the private keys, a technical and legal challenge that could take years to resolve. Arkham has not provided further details on how the operators maintain control over the funds, but the dormancy of the wallets suggests that the funds remain secure and unclaimed.

The situation has reignited discussions about how governments should manage seized cryptocurrency. German lawmaker and Bitcoin advocate Joana Cotar criticized the sale of the earlier Bitcoin holdings, arguing that holding the assets would have yielded greater returns. She has called for a sovereign Bitcoin reserve strategy, positioning Germany among nations like Ukraine and the United States in using digital assets to bolster state finances. Conversely, Bundesbank President Joachim Nagel has expressed skepticism, comparing Bitcoin’s volatility to the 17th-century Tulip Mania and reinforcing Germany’s cautious stance on integrating digital assets into national financial planning.

The potential recovery of the 45,000 BTC could also influence Bitcoin’s market dynamics. Analysts note that the earlier sale in mid-2024 caused temporary selling pressure, though the market absorbed the flow. A similar large-scale liquidation of the newly uncovered Bitcoin could trigger comparable volatility. The current uncertainty surrounding the fate of the dormant wallets highlights the complexities of managing digital assets within legal frameworks not initially designed for cryptocurrencies. As Bitcoin’s global prominence continues to grow, the debate over how governments should handle such assets is likely to intensify.
